By accessing or using our website (beckandsmith.in) (“Website”) and placing an order, you agree to be bound by these Terms & Conditions (“T&C”), our Privacy Policy, and any additional policies referenced herein. If you do not agree with any part of these T&C, please do not use our Website or place an order.

1. Definitions

  • “We”, “us”, “our” refers to Beck & Smith, a cosmetics / personal care brand registered in India.
  • “You”, “your”, “customer” means the user of the Website placing an order.
  • “Products” means the cosmetic items, skincare, body-care products, face wash, body lotions, etc, offered on the Website.
  • “Order” means your order for Products placed via the Website.
  • “Agreement” refers to these Terms & Conditions together with any policy incorporated herein.
  • 2. Use of the Website

2.1 You must be at least 18 years old (or the age of legal majority in your jurisdiction) to purchase Products from the Website.
2.2 You agree to provide accurate, current and complete information when creating an account or placing an Order.
2.3 You agree not to use the Website for any illegal or unauthorised purpose.
2.4 All content on the Website (text, graphics, images, logos, product descriptions) is our intellectual property or used with permission. You may not reproduce, distribute or exploit it without our written consent.

3. Product Information & Pricing

3.1 We make all reasonable efforts to display Products accurately, including colours, dimensions, ingredient lists and descriptions. However, your display device may show colours differently, and actual Product may vary slightly.
3.2 Prices displayed are in Indian Rupees (INR) unless otherwise stated. We reserve the right to change prices at any time without prior notice. Price for a Product shall be as confirmed in your Order before you make payment.
3.3 We reserve the right to withdraw or discontinue a Product at any time without notice.

4. Order Acceptance & Payment

4.1 Once you place an Order, we will send you an electronic Order acknowledgement. This is not acceptance of your Order. Your Order is accepted only when we dispatch your Product (or notify you that the Product is ready for shipment).
4.2 We offer payment methods listed on the Website (for example credit/debit card, UPI, net-banking, cash on delivery). Payment must be made before dispatch (unless cash on delivery is selected).
4.3 If we detect any fraud, misuse or unauthorised activity, we may refuse or cancel an Order, even after payment.

5. Shipping & Delivery

5.1 We ship Products to the addresses specified in your Order within India. Delivery time-frames are estimates only and subject to change due to carrier delays, natural disasters, strikes or other events beyond our control.
5.2 Risk of loss and title for the Products pass to you when we deliver the Products to the carrier.
5.3 You must inspect the Product upon delivery and notify us of any visible damage, shortage or discrepancy within [insert time, e.g. 24 hours] of receipt.

6. Returns, Refunds & Exchanges

6.1 Our Returns & Refund Policy applies (and forms part of this Agreement). Please review it carefully to understand your rights and obligations.
6.2 Unless otherwise stated, Products must be returned in original packaging, unused, with all labels and seals intact.
6.3 We reserve the right to refuse a return, refund or exchange if the Product shows signs of use, damage, tampering or non-compliance with our policy.
6.4 Refunds will be processed by us via the original payment method within a reasonable time following our acceptance of the return.

7. Intellectual Property

7.1 All trademarks, service-marks, logos, trade names, product designs, content and materials on the Website are our property or licensed to us.
7.2 You may not use our trademarks, trade names or logos without our prior written permission.
7.3 You grant us a non-exclusive, worldwide, royalty-free licence to use any feedback, suggestions or ideas you submit relating to the Products or Website.

8. Limitation of Liability

8.1 To the maximum extent permitted by applicable law, we shall not be liable for any indirect, special, incidental, consequential or punitive damages arising out of or relating to your access to or use of the Website or the Products.
8.2 Our total liability to you in respect of all losses arising out of or in connection with this Agreement shall not exceed the amount paid by you for the Order placed.
8.3 Nothing in this Agreement shall exclude or limit liability for (i) death or personal injury caused by our negligence; or (ii) fraud or fraudulent misrepresentation; or (iii) any liability which cannot by applicable law be excluded or limited.

9. Indemnification

You agree to indemnify, defend and hold harmless Beck & Smith, its officers, directors, employees, agents and affiliates from and against any and all claims, liabilities, damages, losses or expenses (including legal fees) arising from (i) your breach of this Agreement; (ii) your misuse of the Website; (iii) your violation of any law or the rights of a third-party.

10. Privacy & Data Protection

Your use of the Website is also governed by our Privacy Policy (link). We collect, process and store your personal information in accordance with applicable data protection and privacy laws. By using the Website, you consent to such collection and use.

11. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of [insert city/state, e.g. Kota, Rajasthan].

12. Severability
